TERMS & CONDITIONS

Article 1: General

1.1 Parties Involved
These terms and conditions apply to all rental agreements of Canal Cruising Utrecht.

• Lessor: Canal Cruising Utrecht, the entity renting out vessels.

• Lessee: The person entering into an agreement with Canal Cruising Utrecht or to whom a quotation has been issued.

1.2 Applicability
By entering into a rental agreement with reference to these terms, the Lessee accepts the applicability of these terms and conditions.

1.3 Deviations
Deviations from these terms are only valid if expressly agreed in writing. Any general terms of the Lessee are expressly rejected unless agreed in writing.

1.4 Unforeseen Situations
Any situation not covered by these terms will be interpreted in line with their purpose and spirit.

1.5 Amendments
Canal Cruising Utrecht reserves the right to amend these terms. Minor changes can be made at any time. If the Lessee disagrees, they may cancel the agreement up to the date the changes take effect.

Article 2: General Rules

2.1 Subject Rule

The Lessee and their party must adhere to all rules. Canal Cruising Utrecht may terminate the rental without refund in case of misconduct.

Photos may be taken during the trip and shared with you. Consent is required for sharing photos on social media.

Different rates apply during King's Day, Liberation Day, UIT Week, and Canal Pride.

Lessee must be at least 18 years old.

Operating under the influence of alcohol or drugs is strictly prohibited.

Bringing speakers on board is not allowed.

The boat must not be left unattended at non-designated locations while activated.

Rates may change until a booking is confirmed. After confirmation, the agreed rate applies.

Always navigate starboard (right), avoid waves, give priority to commercial vessels, avoid mooring at forbidden locations, and carry life-saving equipment.

Article 3: Rental Period

Rental starts at the agreed time; late arrival does not entitle Lessee to extra time.

Extra time must be requested via WhatsApp or phone; subject to approval and standard hourly rates.

Late Return: Double hourly rate applies. Additional charges may be applied after 22:00.

Early Return: No refund unless agreed otherwise.

Boat must be returned clean; otherwise, cleaning fees apply.

Boat must be properly secured at return.

Changes in reservation only accepted via WhatsApp; confirmation must be via WhatsApp.

Boat must be returned to the departure location (Oosterkade), or extra costs may apply.

Article 4: Pets

Dogs onboard are allowed if well-behaved.

Use a blanket to protect cushions from pet hair.

Lessee must clean up after their pet; failure to do so may result in extra costs.

Article 5: Responsibilities

5.1 Vessel Condition
Canal Cruising Utrecht ensures the boat is in good condition and suitable for use.

5.2 Insurance
The vessel is insured (liability & hull) for the agreed sailing area.

5.3 Subleasing
Subleasing is prohibited. Lessee remains responsible until the boat is moored at the departure location.

5.4 Compliance with Rules
Lessee must comply with all applicable boating rules and act as a responsible user.

5.5 Safety Check
Lessee must verify safety equipment is present before departure.

5.6 Proper Use
The vessel must be used responsibly and not be altered. Repairs are only done by Canal Cruising Utrecht.

5.7 Deposit
May be withheld for improper conduct or if the boat is left dirty.

5.8 Instructions
Lessee must follow all instructions. Failure to do so results in liability for damages.

5.9 Availability
Lessee must be reachable at the number provided during booking.

5.10 Transfer
The vessel must be returned in the original condition.

Article 6: Deposit and Payments

Canal Cruising Utrecht is using a deposit for Lessee.

Extra Payment may occur in case of damage, late return, or extra sailing time.

Article 7: Damage & Liability

Insurance

All vessels are insured. An extra deposit serves as the deductible.

Damage Must be reported immediately. Failure to do so may void insurance and lead to full deposit retention.

Non-Compliance may result in full liability for damages.

Reckless or negligent behavior leads to full liability, insurance may not cover.

Lessee is liable for third-party damages not covered by insurance.

Full liability for damage outside area incurred outside the agreed area.

Vessel must be returned in original condition or extra costs will be charged.

Canal Cruising Utrecht is not liable for personal damage except in case of gross negligence.

Personal Belongings: Not liable for loss or damage to Lessee’s property.

Article 8: Cancellations

Period Refund Policy: >2 hrs free cancellation.

KNMI weather warning and raining 100% refund.

In case of KNMI code yellow/orange/red, trip can be cancelled for fee or rescheduled free of charge within one year.

Exceptation: no cancellation for UIT Week, Liberation Day, King's Day, Canal Pride.

Article 9: Force Majeure

Situation Clause

Definition Includes all external causes beyond control (e.g. strikes, weather).

Obligations are suspended during force majeure. After 2 months, either party may cancel without damages.

Fulfillment Payment may still be required for already fulfilled services.

Article 10: Complaints & Disputes

Complaints must be submitted in writing and sent via e-mail, substantiated, and within a reasonable time.
